1. Who we are and what we do

Cloudscene respects your privacy. We offer services that connect enterprise buyers and sellers of network, colocation, cloud and connectivity services on the global digital procurement platform www.cloudscene.com and related tools and offerings (our Services).

This policy explains how Cloudscene collects your personal data through our Services and how we use, share, store and retain your personal information. Personal data means any information relating to an identified or identifiable natural person.

3. Our collection of personal data
Information collected directly from you
The personal data we collect directly from you will be apparent from the context in which you provide the information. In particular:
a.When you join Cloudscene and create an account, we collect your name, business email address, password, position title and role type, company name and country.

b. We may collect your name, email address and company name as well as any other information you choose to provide directly to us: (i) as part of your business relationship with us, (ii) in response to marketing or other communications, (iii) through social media or online forums, (iv) in connection with an actual or potential business relationship with us, (v) when you fill in an online form or contact our team by phone or email, or (vi) when you give us your business card or contact details in person.

c. At your request, we may use information you provide to us or we may access your account to assist you to use our Services, troubleshoot or provide customer support.

Data created through use of our Services
When you visit or use our Services, we collect:
Device information: We log information about your device including your device IP address (from which we can infer your general location) and technical data related to the device(s) you are using to access our Services.

Service data: We collect information about how you interact with our Services, such as access dates and times, page views, which activities and features you use, crash logs and browser configuration settings.

Email data: We use page tags (also known as web beacons) in the emails we send to subscribers and users. This means when you receive and engage with messages we send to you, web beacons track certain behaviour such as whether the email sent to you was delivered and opened and whether you clicked on a link in the email.

In some cases, we collect this data through cookies, pixels, tags and similar tracking technologies that create and maintain unique identifiers. You can easily exercise your rights to control our use of cookies and other tracking technologies and find out more information in your Privacy Settings.
Data from other sources

Our Services allow companies to create teams and company profiles. Team members within your organisation may provide us with your business contact information, such as your name, business email address, phone number, job title or role. In some cases, we may also collect business contact information from public sources or from third-party service providers who license your data to us. We use this data for direct marketing purposes based on our legitimate interests in marketing our services to your employer. You can exercise any of your rights described in this Policy, including the right to ask us to erase your business contact information or object to the processing, by contacting our Data Protection Officer at privacy@cloudscene.com.

Cloudscene may combine the data collected from these sources with other data in its possession.

4. How we use personal data
We rely upon a number of legal grounds as outlined in this section to ensure that our use of your personal data is compliant with applicable law.

Cloudscene will de-identify or destroy personal data when no longer required by us.

Contractual and pre-contractual business relationships.

We use personal data for the purpose of entering into business relationships with prospective Cloudscene users and suppliers, and to perform contractual obligations under the contracts that we have with users, enterprises and advertisers.
Activities that we conduct in this context include:
a. creation and management of user and team accounts and maintenance of our directory and user credentials;
b. enterprise account support on request, which may include creating or responding to listings or quote requests and accessing user accounts for support and troubleshooting;
c. accounting, auditing, and billing activities; and
d.communications regarding your account, use of the Services and related customer service.

Legitimate interests.
When we process your data on the basis of legitimate business interests, we take measures and ensure safeguards are in place to protect your rights and interests.
Specifically, we process personal data:
a. To enable us to deliver and improve our services.
b.To detect, prevent and address technical issues in the interests of business continuity and ensuring Services operate as intended.
c. For direct marketing where you have expressed an interest in one or more of our Services, completed an online form or otherwise indicated your interest in pursuing a business relationship, but only if we think you are able to reasonably expect at the time and in the context of collection of the data that processing for the purpose of direct marketing may take place. We do this in the interest of growing Cloudscene’s business.
d. For the purpose of keeping our Services safe and secure in the interests of prevention of fraud or misuse of our Services and protection of Cloudscene’s database. This may include the use of Google’s invisible reCAPTCHA tool to tell humans apart from spam bots abusing our systems. The reCAPTCHA tool’s algorithm may make use of cookies as well as other information like IP address, hardware and software information and user interaction data, and this data may be sent to Google for analysis in accordance with Google’s terms of service and privacy policy.
e. For the investigation and enforcement of legal claims, debt collection via out-of-court procedures and other dispute resolution procedures to enable us to ensure that Cloudscene’s rights are protected and to seek remedies if necessary.
f. For research and analytics purposes, including to count visits and traffic sources so we can measure and improve the performance of our platform, improve our Services or offer and develop new services.
g. To create aggregated customer segments, which we use to target our marketing (including emails), for example based on the location of the business you work for, your position title, company type or your actions (such as whether you have clicked on an ad or a link). We will always obtain your consent prior to sharing this information with third parties. We do this to enable Cloudscene to understand its users’ needs and demographics to grow its business and so that Cloudscene’s marketing is more effective by reason of it being more relevant and useful to recipients.
Consent.
a. If you consent, we may process your data or share it with third parties for the purposes of marketing, advertising and related analytics.

If our data collection or processing is based on your consent, you may at any time withdraw your consent with effect for the future by email to privacy@cloudscene.com. If you have signed up for a Cloudscene account, you can also manage your account communication preferences in your Account Settings.

Complying with legal obligations.
In limited circumstances, we may need to process your personal data in order to comply with our financial, regulatory and other legal obligations.
 
 
5. Who Cloudscene shares personal data with

Service Providers.
We may share your information with a limited number of third party service providers who we engage to perform tasks or provide capabilities on our behalf. These companies include (for example) our cloud storage providers (e.g. Amazon Web Services), customer relationship management software providers (e.g. Salesforce), email service providers (e.g. CampaignMonitor) and others.

The organizations that Cloudscene shares personal data with are located throughout the world, but predominantly in the United States, European Union and Australia. If you are in the European Union, some of the countries to which data will be transferred in our use of service providers, such as the United States and Australia, may not necessarily have data protection laws as comprehensive or protective as those in your country of residence. Cloudscene has adopted internal policies and implemented measures to ensure appropriate and suitable safeguards are in place in relation to such transfers. Advertising
If you consent, third party ad networks (such as Google and Facebook) may store cookies in your browser when you use our Services. Ad networks may use the information obtained from cookies  to target advertising to you, including through behavioural advertising, to measure the effectiveness of advertising and to personalize content and ads you see while visiting sites or apps within their network. You can control the use of tracking technologies and withdraw consent at any time in your Privacy Settings.
Purchasers of Cloudscene business.
If any Cloudscene group company or substantially all of its assets are acquired by a third party, the personal data held by it about its customers will be one of the transferred assets.
 
 
6. Your rights and choices
Depending on your location and subject to applicable laws, you may have the following rights with regard to the person data we control about you:
a. The right to request access to and rectification of personal data relating to you.
b. The right to request that we erase your personal data in certain circumstances provided by law.
c. The right to request that we restrict our use of your personal data in certain circumstances, such as while we consider another request that you have submitted.
d. Where the processing of your personal data is based on your previously given consent, you have the right to withdraw your consent at any time.
e. The right to object to the processing of your personal data for direct marketing purposes or on grounds relating to your particular situation.

Our Services may, from time to time, contain links to or redirect you to the websites or services of third parties (such as the payment platform of our payment processor, Stripe). Before providing your personal data to any third party, we recommend you review their privacy policy which governs how they will process and protect your information.
